Основными видами, с которыми работают агенты является общая и индивидуальная собственность. Когда мы говорим об индивидуальной собственности, объект права находится в собственности у одного лица (физического или юридического). Если же мы говорим об общей собственности, то тут соответственно объект права находится в собственности двух или более лиц. 00:01:39 Долевая собственность Общая собственность в свою очередь может быть долевой и совместной, совместно-долевой не бывает, она либо долевая, либо совместная. В долевой собственности доли каким-то образом определены между совладельцами, они могут быть как равные, так и распределены любым образом, а участниками могут быть любые лица. При продаже доли или долей, необходимо обязательно соблюдать требование 250 статьи Гражданского Кодекса РФ - "Требование о преимущественном праве покупки". То есть остальные участники этой долевой собственности имеют преимущественное право на приобретение. Кроме того агент должен помнить, что отчуждение недвижимого имущества находящегося в долевой собственности, подлежит нотариальному удостоверению. То есть тот договор, на основании которого происходит отчуждение подлежит обязательному нотариальному удостоверению. 00:03:25 Совместная собственность В отличии от долевой собственности, в совместной собственности доли не определены, а владение осуществляется сообща. Более того, после принятия в 1995 году Гражданского кодекса РФ, режим совместной собственности возможен только для супругов. При этом в документах может быть поименован только один из них, то есть титульный собственник, либо оба. В случае отчуждения недвижимого имущества, находящегося в совместной собственности супругов, требуется нотариальное согласие второго супруга. Требование о нотариате на этот вид собственности не распространяется, потому что она не долевая. 00:05:19 Неправомерные действия при продаже Общая долевая собственность возможна только при условии, что имуществом владеют несколько лиц, поэтому если одним объектом владеет только одно лицо, то оно не может отчуждать долю этого объекта, у него нет доли, у него есть целый объект. Невозможно отпилить от целого объекта долю и кому-то ее продать. Лицо, имеющее в собственности целый объект не обладает правом долевой собственности на этот объект. Исключением из этого правила являются случаи, когда распоряжение долей происходит в связи с распоряжением органа опеки и попечительства, то есть наделение долей несовершеннолетнего. Также исключением является технически делимое имущество: земельный участок или жилой дом, когда предварительно собственником произведен раздел имущества с выделом долей в натуре. Здесь уже не долевая собственность, а возникновение двух отдельных объектов. 00:07:27 Раздел совместного имущества По общим правилам, имущество, приобретенное супругами в период брака, является их совместной собственностью, только если данное обстоятельство не изменено брачным договором. В последствии, если встает вопрос о разделе совместно-нажитого имущества супругов, все нюансы покупки обсуждаются и доказываются в судебном порядке. Априори, все имущество, купленное в браке, является совместно-нажитым, независимо от того, на чье имя оно оформлено. 00:08:20 Преимущественное право покупки При отчуждении доли в праве собственности на недвижимое имущество, которое не обладает самостоятельным кадастровым номером, то есть существует в виде доли, или при отчуждении комнаты, обязательно соблюдение требований статьи 42 Жилищного Кодекса в вопросе о комнате, и статьи 250 Гражданского Кодекса РФ если речь о долях. На связи Мария Кузнецова. Сегодня продолжаю отвечать на ваши вопросы, которые вы задаете в комментариях по поводу деления квартир на судии и, соответственно, по поводу заработка на этой стратегии. Итак, давайте разберем сегодня вопросы. Спрашивает Татьяна Селукова: «Здравствуйте! В 2016 году купили трешку и сделали 2 студии и полноценную однокомнатную квартиру. Как продать квартиру студию? Все узаконено. 2 года занимались сдачей посуточно. Сейчас хочу продать, но не знаю, как правильно это сделать. Квартира в ипотеке. Мы хотим продать только студии, а квартиру оставить. Как научиться продавать квартиры? Продажа двух студий полностью закрывает ипотеку, еще и деньги остаются. Буду очень признательна, если подскажете». Подскажу! Так как это ипотека, то это немножечко другой вариант. В любом случае эта сделка должна проходить через нотариуса. Если бы вы продавали все студии сразу (студии, квартиру), если они в общедолевой собственности и, если вы продаете все 100% долей, значит, можно совершать сделку, как через нотариуса, так и в простой письменной форме. Но так как вы продаете только часть своей квартиры по факут, я так понимаю, что под фразой «все узаконено» вы подразумеваете, что вы узаконили перепланировку, а кадастры у вас так и остались – один кадастровый номер, соответственно, у вас продаются доли, как я поняла. Бизнес на недвижимости. В этом случае, когда вы продаете, в процессе отчуждения от нас уходит не 100%, а меньший процент доли, соответственно, эта сделка будет только через нотариуса. Это вам важно знать. Как увеличить свой доход? Дальше вопрос: «Что сделать с ипотекой?». Самый простой вариант – это взять с людей аванс желательно 100%, если у вас своих денег нет на закрытие ипотеки. Как заработать деньги? Заключить с покупателями предварительный договор купли-продажи, взять с них деньги, эти деньги отнести в банк, закрыть ипотеку и после этого продолжить сделку, то есть, заключить уже обычный договор купли-продажи через нотариуса. The CIA was aware of the cocaine transactions and the large shipments of drugs into the U.S. by the Contra personnel and directly aided drug dealers to raise money for the Contras. Although he heavily implied CIA involvement, Webb never claimed to have made a direct link between the CIA and the Contras. The program's heyday was in the early 1950s, when radio actor, producer and director Elliott Lewis took over (still during the Wilcox/Autolite run). Here the material reached new levels of sophistication. The writing was taut, and the casting, which had always been a strong point of the series (featuring such film stars as Orson Welles, Joseph Cotten, Henry Fonda, Humphrey Bogart, Judy Garland, Ronald Colman, Marlene Dietrich, Eve McVeagh, Lena Horne, and Cary Grant), took an unexpected turn when Lewis expanded the repertory to include many of radio's famous drama and comedy stars — often playing against type — such as Jack Benny. Jim and Marian Jordan of Fibber McGee and Molly were heard in the episode, "Backseat Driver," which originally aired February 3, 1949. The highest production values enhanced Suspense, and many of the shows retain their power to grip and entertain. At the time he took over Suspense, Lewis was familiar to radio fans for playing Frankie Remley, the wastrel guitar-playing sidekick to Phil Harris in The Phil Harris-Alice Faye Show. On the May 10, 1951 Suspense, Lewis reversed the roles with "Death on My Hands": A bandleader (Harris) is horrified when an autograph-seeking fan accidentally shoots herself and dies in his hotel room, and a vocalist (Faye) tries to help him as the townfolk call for vigilante justice against him. With the rise of television and the departures of Lewis and Autolite, subsequent producers (Antony Ellis, William N. Robson and others) struggled to maintain the series despite shrinking budgets, the availability of fewer name actors, and listenership decline. To save money, the program frequently used scripts first broadcast by another noteworthy CBS anthology, Escape. In addition to these tales of exotic adventure, Suspense expanded its repertoire to include more science fiction and supernatural content. By the end of its run, the series was remaking scripts from the long-canceled program The Mysterious Traveler. Our Miss Brooks is an American situation comedy starring Eve Arden as a sardonic high school English teacher. It began as a radio show broadcast from 1948 to 1957. When the show was adapted to television (1952--56), it became one of the medium's earliest hits. In 1956, the sitcom was adapted for big screen in the film of the same name. Connie (Constance) Brooks (Eve Arden), an English teacher at fictional Madison High School. Osgood Conklin (Gale Gordon), blustery, gruff, crooked and unsympathetic Madison High principal, a near-constant pain to his faculty and students. (Conklin was played by Joseph Forte in the show's first episode; Gordon succeeded him for the rest of the series' run.) Occasionally Conklin would rig competitions at the school--such as that for prom queen--so that his daughter Harriet would win. Walter Denton (Richard Crenna, billed at the time as Dick Crenna), a Madison High student, well-intentioned and clumsy, with a nasally high, cracking voice, often driving Miss Brooks (his self-professed favorite teacher) to school in a broken-down jalopy. Miss Brooks' references to her own usually-in-the-shop car became one of the show's running gags. Philip Boynton (Jeff Chandler on radio, billed sometimes under his birth name Ira Grossel); Robert Rockwell on both radio and television), Madison High biology teacher, the shy and often clueless object of Miss Brooks' affections. Margaret Davis (Jane Morgan), Miss Brooks' absentminded landlady, whose two trademarks are a cat named Minerva, and a penchant for whipping up exotic and often inedible breakfasts. A sometime love interest for Walter Denton, Harriet was honest and guileless with none of her father's malevolence and dishonesty. Stretch (Fabian) Snodgrass (Leonard Smith), dull-witted Madison High athletic star and Walter's best friend. Daisy Enright (Mary Jane Croft), Madison High English teacher, and a scheming professional and romantic rival to Miss Brooks. Jacques Monet (Gerald Mohr), a French teacher. Our Miss Brooks was a hit on radio from the outset; within eight months of its launch as a regular series, the show landed several honors, including four for Eve Arden, who won polls in four individual publications of the time. Arden had actually been the third choice to play the title role. Harry Ackerman, West Coast director of programming, wanted Shirley Booth for the part, but as he told historian Gerald Nachman many years later, he realized Booth was too focused on the underpaid downside of public school teaching at the time to have fun with the role. Lucille Ball was believed to have been the next choice, but she was already committed to My Favorite Husband and didn't audition. Chairman Bill Paley, who was friendly with Arden, persuaded her to audition for the part. With a slightly rewritten audition script--Osgood Conklin, for example, was originally written as a school board president but was now written as the incoming new Madison principal--Arden agreed to give the newly-revamped show a try. Produced by Larry Berns and written by director Al Lewis, Our Miss Brooks premiered on July 19, 1948. According to radio critic John Crosby, her lines were very "feline" in dialogue scenes with principal Conklin and would-be boyfriend Boynton, with sharp, witty comebacks. The interplay between the cast--blustery Conklin, nebbishy Denton, accommodating Harriet, absentminded Mrs. Davis, clueless Boynton, scheming Miss Enright--also received positive reviews. Arden won a radio listeners' poll by Radio Mirror magazine as the top ranking comedienne of 1948-49, receiving her award at the end of an Our Miss Brooks broadcast that March. "I'm certainly going to try in the coming months to merit the honor you've bestowed upon me, because I understand that if I win this two years in a row, I get to keep Mr. Boynton," she joked. But she was also a hit with the critics; a winter 1949 poll of newspaper and magazine radio editors taken by Motion Picture Daily named her the year's best radio comedienne. For its entire radio life, the show was sponsored by Colgate-Palmolive-Peet, promoting Palmolive soap, Lustre Creme shampoo and Toni hair care products. Clifford Charles "Cliff" Arquette (December 27, 1905 -- September 23, 1974) was an American actor and comedian, famous for his TV role as Charley Weaver. Arquette was born in Toledo, Ohio, the son of Winifred (née Clark) and Charles Augustus Arquette, a vaudevillian. He was the patriarch of the Arquette show business family, which became famous because of him. Arquette was the father of the late actor Lewis Arquette and the grandfather of actors Patricia, Rosanna, Alexis (originally Robert), Richmond, and David Arquette. He was a night club pianist, later joining the Henry Halstead orchestra in 1923. Arquette had been a busy, yet not nationally known, performer in radio, theatre, and motion pictures until 1956, when he retired from show business. At one time, he was credited with performing in 13 different daily radio shows at different stations in the Chicago market, getting from one studio to the other by way of motorboats along the Chicago River through its downtown. One such radio series he performed on was The Adventures of Wild Bill Hickok Arquette and Dave Willock had their own radio show, Dave and Charley, in the early 1950s as well as a television show by the same name that was on the air for three months. Arquette performed on the shows as Charley Weaver. The story that Arquette later told about his big break was that one night in the late 1950s he was watching The Tonight Show. Host Jack Paar happened to ask the rhetorical question, "Whatever became of Cliff Arquette?" That startled Arquette so much that, "I almost dropped my Scotch!" In 1959, Arquette accepted Paar's invitation to perform on Paar's NBC Tonight Show. Arquette depicted the character of "Charley Weaver, the wild old man from Mount Idy." He would bring along, and read, a letter from his "Mamma" back home. This characterization proved so popular that Arquette almost never again appeared in public as himself, but nearly always as Charley Weaver, complete with his squashed hat, little round glasses, rumpled shirt, broad tie, baggy pants, and suspenders. Although a good number of Arquette's jokes appear 'dated' now (and, arguably, even back then), he could still often convulse Paar and the audience into helpless laughter by way of his timing and use of double entendres in describing the misadventures of his fictional family and townspeople. As Paar noted, in his foreword to Arquette's first Charley Weaver book: "Sometimes his jokes are old, and I live in the constant fear that the audience will beat him to the punch line, but they never have. And I suspect that if they ever do, he will rewrite the ending on the spot. I would not like to say that all his jokes are old, although some have been found carved in stone. What I want to say is that in a free-for-all ad lib session, Charley Weaver has and will beat the fastest gun alive."
